Moments prior to her veering off the median and crashing into an oncoming truck the woman had posted on Facebook how happy, Pharrell Williams Happy song made her. The Facebook text happened at 8:33. We got the call on the wreck at 8:34, told Lt. Chris Weisner, with the High Point Police Department. Investigators say Sanfords Facebook post read: The happy song makes me HAPPY. In a matter of seconds, a life was over just so she could notify some friends that she was happy, added Weisner. These sorts of head-scratchers have led to suggestions that liability concerns might become a major impediment to the rollout of advanced autonomous vehicle technologies. An article last year in theSan Diego Union-Tribuneobserved that, according to experts, the issue of liability, if not solved, could delay or even wipe out the vision of driverless cars gaining widespread consumer use. MSN ran a story under the title Will lawsuits kill the autonomous car?, and theWall Street Journalpublished an article titled Liability Issues Create Potholes on the Road to Driverless Cars. Theres no doubt that accidents involving autonomous vehicles will put challenging new liability questions before the courts. But that doesnt mean the courts will be unable to address them. And it doesnt mean that we have to put the autonomous-vehicle industry on hold so legislators can attempt to preemptively draft and enact an entirely new set of liability laws that anticipate everything that might go wrong. Its an exercise that would be as impossible as it is unnecessary. Why?
